1. Eligibility: NO PURCHASE NECESSARY. The “OMARION TRIVIA QUIZ AND RAP WITH OMARION” (the “Sweepstakes”) is open to legal permanent residents of the United States who are thirteen (13) years of age or older. The Sweepstakes is void in Puerto Rico, U.S. territories and possessions, outside of the U.S., and where otherwise prohibited by federal, state, provincial, municipal or local law. All federal, state, local, and municipal laws and regulations apply. Employees of SONY BMG Music Entertainment and Sony Music Mobile, their respective parents, affiliates, subsidiaries, divisions and advertising and promotion agencies, or of any entity involved in the development, production, implementation and distribution of the Sweepstakes, including any advertising or promotion agency, supplier of prizes for the Sweepstakes, parent company, service provider, subsidiary or affiliate of any such entity or any other entity directly associated with the Sweepstakes (hereinafter the "Sweepstakes Entities”) or any member of the immediate family of and/or person living in the same household as such persons, are not eligible. Minors must have their parent or guardian's permission to enter as described below. Contestants ages 13-21 may be required to have their parent or guardian's permission to enter as described below 2. How to Enter: This Sweepstakes ends at April 25 , 2005, midnight EST, except that post card entries may be received until May 2, 2005, midnight EST (each, as applicable, the “End Date”). Entries must be received by Sponsor no later than the applicable End Date. Entries that do not comply with these Official Rules in all respects are ineligible and void.
Eligible Customers of Eligible Cellular Phone Service Carriers may enter the Sweepstakes in any of the following ways: An “Eligible Customer of Eligible Cellular Phone Service Carriers” shall mean any person who: (i) subscribes to cellular phone service provided by one of the following cellular phone service providers: Verizon Wireless, Sprint PCS, AT&T; Wireless/Cingular Wireless, and T-Mobile USA (each, an “Eligible Carrier”), and (ii) has the capability of sending Premium SMS messages via their cellular phone. Each Eligible Customer of Eligible Carrier may enter the Sweepstakes no more than thirty (30) times, through any combination of the three methods described above. If more than thirty (30) entries are received from the same entrant, only the first thirty (30) entries submitted by that entrant will qualify for entry in the Sweepstakes; subsequent entries submitted by that entrant shall be disqualified. However, there is not a limit on the number of entries in the Omarion Trivia Quiz an Eligible Customer of Eligible Cellular Phone Service Carriers can purchase. Information requested during the entry process via cellular phones (as described above) consists of user’s age, name, address (including zip code), cellular phone number and valid email address. IF YOU ARE BETWEEN 13 AND 21 YEARS OF AGE, YOU MAY NOT ENTER UNLESS YOU HAVE FIRST OBTAINED YOUR PARENT OR GUARDIAN'S PERMISSION.
3. Prizes: Thirty (30) Runner-Up Prizes shall each consist of one (1) autographed copy of the Omarion compact disc (CD) entitled “O” Estimated retail value of each Runner-Up Prize: $19.98. The Estimated retail value of all of the prizes that will be awarded pursuant to the Sweepstakes is: $999.40. First Prize winners must possess a valid and current cellular phone service account with an Eligible Carrier between March 14, 2005 and May 16, 2005 and be available either to receive a phone call during that period or to participate in a conference call during that period using a toll free phone number provided by Sponsor. Sponsor will either have Omarion attempt to call First Prize winner or attempt to schedule a phone call with Omarion and the First Prize winner no more than three (3) times during such period, without any advanced notice. If First Prize winner is unavailable during the proposed times or otherwise does not answer after three (3) attempts to call or schedule a call, that person shall be deemed to have forfeited the phone call portion of the First Prize. No substitutions, transfer, or cash equivalent of prizes by any winner. Sponsor at its sole discretion, may substitute a prize of equal or greater value for one or more of the prizes described above. 4. Drawing and Notification: Winner(s) will be selected in a random drawing on or about one (1) week after all eligible entries received by the Sponsor, whose decisions are final and binding in all respects. Odds of winning depend on the number of eligible entries received. Winners will be notified by cellular phone and/or regular phone. If a potential winner cannot be reached at the cellular phone number used to enter the Sweepstakes or the phone number provided on the post card used to enter the Sweepstakes within five (5) days from Sponsor’s first attempt to contact him/her, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate winner will be selected by random drawing. All entries become Sponsor's property and will not be returned. The cellular phone number used by entrant to enter the Sweepstakes shall serve as the cellular phone number of record in respect of all phone calls or messages sent via cellular phone service to that entrant, except that the phone number (cellular or otherwise) provided by entrant on an entry post card shall serve as the phone number of record in respect of all phone calls sent via phone to that entrant (if that entrant’s post card entry is selected). Changes to such phone numbers or the failure to maintain phone service between March 14, 2005 and May 16, 2005 may serve as a basis for disqualification of the entrant concerned. 5. General Conditions: All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. All other costs not specifically stated herein are the responsibility of the winner. Prize winners (and parent(s) or guardian(s) of prize winners under 21) may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and/or a Publicity Release (the "Affidavit/Release") each of which must be returned to and received by Sponsor within ten (10) days from winner’s receipt of the Affidavit/Release concerned. Winners will also be required to send a copy of their passport, driver’s license or birth certificate as proof of age and residency. Non-compliance with any of these requirements may result in disqualification, in which case an alternate winner may be chosen. Return of any prize, prize notification, or Affidavit/Release as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of any prize(s) constitutes permission for the Sponsor and its affiliates to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law. All entrants agree to comply fully with each provision in these Official Rules. Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules will be ineligible for prizes and may be prosecuted to the full extent of the law. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS. If, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Sweepstakes is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Sweepstakes, without liability. The Sweepstakes is void where restricted or prohibited by law. 6. Disclaimers: Entrants agree that the Sweepstakes Entities shall not be liable for losses or injuries of any kind resulting from: (i) acceptance/possession and/or use/misuse of prize(s), (ii) participation in the Sweepstakes, (iii) individual, joint or collective technical malfunctions of the telephone network and/or transmission line, computer on-line system, computer dating mechanism, computer equipment, hardware and/or software, or (iv) any delay or distortion of an entry resulting from data transmissions that are garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. 7.
